Terms of Service

These Terms of Service ("Terms") explain the rules that apply when you download, access, or use Gear Browser, including the iOS app, Gear Pro features, extension engine, official website, documentation, and related services provided by Binary Gear LLC ("Gear," "we," "us," or "our"). By using Gear Browser, you agree to these Terms. If you do not agree, please do not use the Service.

# Acceptance of Terms

These Terms form a legally binding agreement between you and Gear. Your use of Gear Browser may also be subject to additional terms from Apple, websites you visit, search providers, payment providers, extension authors, and other third-party services you choose to use.

You may use the Service only if you are legally able to accept these Terms. If you are under the age required to enter into a binding agreement in your location, you may use the Service only with permission and supervision from a parent or legal guardian.

If you use Gear Browser on behalf of a company, team, or other organization, you represent that you have authority to accept these Terms on that organization's behalf.

# License to Use Gear Browser

Subject to these Terms, Gear grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the executable version of Gear Browser from an authorized source for your own lawful browsing, productivity, testing, and development purposes.

This license does not allow you to copy, sell, rent, lease, sublicense, distribute, host, or commercially exploit Gear Browser except where permitted by applicable law or expressly authorized by Gear in writing. You may not remove copyright, trademark, or other proprietary notices from the Service.

# Privacy and Local Browser Data

Gear Browser is designed as a browser application that runs primarily on your device. Browsing history, bookmarks, downloads, cookies, website data, session data, and similar browser data may be stored locally or handled by Apple's system browser frameworks, depending on your settings and device environment.

Our handling of personal information is described in the Gear Browser Privacy Policy. These Terms incorporate the Privacy Policy by reference. Websites and services you visit through Gear Browser may collect or process data under their own privacy policies.

# Your Responsibilities

You are responsible for how you use Gear Browser, including the websites you visit, information you submit, files you download, extensions or scripts you install, and actions you take through the browser.

You agree that you will not use the Service to:

# Third-party Websites and Content

Gear Browser provides access to the open web. Gear does not own, control, verify, or endorse websites, web applications, search results, advertisements, downloads, media, APIs, or other third-party materials displayed or accessed through the browser.

Third-party content may be inaccurate, offensive, unlawful, unsafe, unavailable, or incompatible with Gear Browser. Your use of third-party websites and services is governed by their own terms, policies, and technical restrictions.

Links in the app, website, or documentation are provided for convenience and do not imply endorsement, sponsorship, or responsibility by Gear.

# Browser Features and Technical Dependencies

Gear Browser may include features such as tabs, private mode, bookmarks, downloads, reader tools, media tools, page translation, content filtering, page inspection, custom scripts and styles, and other browsing or developer-oriented capabilities. Feature availability may vary by app version, device, operating system, region, subscription status, and Apple platform rules.

Gear Browser uses Apple's WKWebView and related iOS technologies to render web content and handle browser functions such as JavaScript, CSS, cookies, web storage, sessions, caching, and media behavior. Some results are determined by Apple system frameworks, website implementation, network conditions, and third-party services outside Gear's control.

# Translation

Gear Browser may provide translation features that extract text from the current page and display translated text inside Gear Browser, without redirecting you to a third-party translation webpage or sending the whole page to Gear-operated servers.

Built-in translation and Intelligent Translation use iOS system translation capabilities and are designed to process translation on your device where available. If you choose an optional third-party translation provider, such as Google or Bing, the page text or other content needed for translation may be sent to that provider and handled under its own terms and privacy policy. Please review the Privacy Policy and choose the translation mode that fits the sensitivity of the page.

Translations may be incomplete, inaccurate, delayed, or unavailable. You should not rely on translation output as professional advice or as the sole basis for legal, medical, financial, safety-critical, or other important decisions.

# Content Filtering

Gear Browser may offer content filtering features for ad blocking, privacy protection, and reducing unwanted page elements. You choose whether to enable these features globally or for individual websites.

Content filtering is provided to improve browsing comfort, performance, and privacy. It is not a guarantee that all ads, trackers, pop-ups, or unwanted elements will be blocked. It may also block or hide content unintentionally.

Gear Browser may rely on third-party open source filter lists, including EasyList, and Apple's native content blocker technology. Gear does not control every rule in third-party lists. If website content is affected by EasyList rules, please contact the relevant list maintainers through EasyList's contact page and review EasyList's policy page.

You must not use content filtering to access protected content without authorization, bypass contractual or technical restrictions, disrupt website operations, or violate third-party terms.

# Extensions, Scripts, and Custom Code

Gear Browser may allow you to install third-party extensions, write or import scripts, apply custom styles, and otherwise modify page behavior. These tools are powerful and may affect privacy, security, performance, compatibility, and how websites function.

Gear does not review, endorse, warrant, or control third-party extensions, scripts, styles, repositories, or code snippets unless we expressly state otherwise. You should install and run code only from sources you trust and only after understanding what it can access or change.

You are responsible for extensions and custom code you create, install, enable, modify, or share. You must not use them to bypass access controls, collect data without authorization, inject malicious behavior, impersonate services, infringe intellectual property, or interfere with third-party systems.

# Gear Pro and Purchases

Gear Pro may provide additional browsing, customization, and development-oriented features. Gear Pro features are intended for lawful personal use, productivity, web development, testing, debugging, and customization.

Gear Pro subscriptions and other in-app purchases are processed by Apple's App Store payment system. Payment is charged to your Apple account when the purchase is confirmed. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period.

You can manage or cancel subscriptions through your Apple account settings. Refunds, purchase disputes, family sharing availability, taxes, renewal notices, and billing issues are handled according to Apple's policies and applicable law.

We may add, modify, or remove paid features over time. If a paid feature becomes unavailable, we will handle the change in accordance with applicable law and Apple platform requirements.

# Intellectual Property

Gear Browser, including its app design, user interface, website, documentation, branding, logos, graphics, and related software elements, is owned by Gear or its licensors and is protected by intellectual property laws.

These Terms do not grant you ownership of Gear Browser or permission to use Gear's names, logos, trademarks, or branding except as necessary to identify the Service in a truthful and non-misleading way.

If you send us feedback, suggestions, bug reports, feature ideas, or other comments, you grant Gear permission to use them without restriction or compensation. Please do not send confidential information through general feedback channels.

# Updates, Changes, and Termination

We may update these Terms to reflect product changes, operational needs, legal requirements, or security considerations. Updated Terms will be posted on this page with the latest update date. Your continued use of the Service after an update means you accept the revised Terms.

We may update, suspend, limit, or discontinue any part of the Service at any time, including features, integrations, documentation, website content, and supported platforms. We may also restrict or terminate access to the Service if we reasonably believe that use of the Service violates these Terms, creates risk, or is unlawful.

You may stop using Gear Browser at any time. Uninstalling the app may remove local app data according to iOS behavior and your device settings.

# Disclaimers and Limitation of Liability

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, Gear disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, security, and uninterrupted operation.

Gear does not guarantee that websites will load correctly, third-party content will be safe or accurate, content filtering will block every unwanted element, extensions will be secure, downloads will be free of harmful content, or the Service will meet every user requirement.

To the maximum extent permitted by applicable law, Gear will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of data, revenue, profits, business, goodwill, device functionality, or access to third-party services arising from or related to your use of the Service.

Some jurisdictions do not allow certain warranty disclaimers or liability limitations. In those jurisdictions, the limitations above apply only to the maximum extent permitted by law.

# Infringement Notices

If you are a rights owner or authorized representative and believe that material associated with Gear Browser infringes your rights, please contact us with enough information to identify the material, explain the alleged infringement, and evaluate your request.

Because Gear Browser primarily provides user-controlled browsing tools and access to third-party websites, we may ask you to contact the website operator, extension author, repository host, app platform, or other third party that controls the disputed material.

# Governing Law and Contact

These Terms and any disputes related to the Service will be governed by the laws of the State of New York and applicable United States law, without regard to conflict of law principles, except where local law requires otherwise.

Nothing in these Terms limits rights you may have under mandatory consumer protection laws that cannot be waived by contract.
